Conditions of participation for the Winora-Staiger GmbH and Ghost-Bikes GmbH 2024 cashback dealer promotion

1. Introduction

By participating in this promotion, the participant agrees to these conditions of participation. In the period from June 1 to September 30, 2024, the Accell Group with the companies Winora-Staiger GmbH and Ghost-Bikes GmbH are organizing a cashback campaign for the brands WINORA, HAIBIKE and GHOST.

As part of the promotion, the Accell Group with the companies Winora-Staiger GmbH and Ghost-Bikes GmbH will grant a refund of up to €300 (in Germany and Austria) or CHF 300 (in Switzerland) for the purchase of a WINORA, HAIBIKE or GHOST brand bicycle that was purchased and successfully registered at authorized dealers in Germany, Austria or Switzerland during the campaign period.

By uploading their proof of purchase on the website https://www.dealer-cashback.com and completing the online form, the participant can request a refund of up to €/CHF 300 for the purchased bicycle to a bank account specified by them in accordance with the following conditions of participation.

The participant will be informed of his/her successful participation by means of a form and an e-mail to the e-mail-address he/she has provided. The participant is also required to check the SPAM-folder for incoming e-mails during the promotion period.

2. Organizer

The organizer of the cashback promotion (hereinafter referred to as the "Promotion") are WINORA-Staiger GmbH, Max-Planck-Str. 6, 97526 Sennfeld (hereinafter referred to as the "Manufacturer" or "WINORA") and GHOST-Bikes GmbH, An der Tongrube 3, 95652 Waldsassen (hereinafter referred to as the "Manufacturer" or "GHOST"). The campaign will be processed via aha! Agentur für Handelsmarketing GmbH, Widdersdorfer Str. 399, 50933 Cologne (hereinafter referred to as "aha!").

3. Eligibility to participate

Only private individuals who are at least 18 years of age at the time of participation, have a permanent residence in Germany, Austria or Switzerland and have a valid bank account that can be reached using the SEPA payment standard are eligible to participate.

Participation is only possible under your own name and as a private individual. Participation in someone else's name, as well as participation with the help of automatically generated mass mailings and as a company is not permitted.

Wholesalers and retailers are not eligible to participate, even if they act on behalf of participant communities and/or customers. Purchases via online auction platforms, purchases of used bicycles and purchases via private individuals who are not acting in the exercise of their commercial or independent professional activity are also excluded from participation in the promotion. The cashback benefit cannot be claimed for leased bicycles.

4. Ways to participate in the promotion

Participation in the promotion is possible by purchasing a bicycle from authorized dealers of Winora-Staiger GmbH or Ghost-Bikes GmbH in Germany, Austria or Switzerland and registering the purchase online at https://www.dealer-cashback.com. Registration requires uploading the proof of purchase and providing personal data (title, first name, last name, address, e-mail-address), your own bank account (IBAN), product information (brand, frame number) and retailer information.

All bicycle models of the following brands are eligible for participation in the cashback campaign:

Only one entry per person is permitted. A purchase receipt can only be used by one participant and only once.

If the purchase contract for one of the bicycles is canceled within 30 days of the conclusion of the contract, for whatever reason, the entitlement to a refund expires.

The participant shall bear the transmission costs incurred by the chosen internet provider.

5. Promotion period

The purchase period for a bicycle of the above brands begins on June 1, 2024 and ends on September 30, 2024. The period for uploading the proof of purchase begins on June 1, 2024 and ends on September 30, 2024.

6. Proof of purchase

The following information must be clearly legible on the photo of the proof of purchase: retailer, product name, unit price, total amount and date of purchase. The photo/document of the proof of purchase must not exceed a file size of eight (8) MB and must be in JPG, PNG or PDF file format. Other formats or larger files cannot be uploaded.

7. Refund amount

Winora will only grant a refund of up to 300 €/CHF for the purchase of a bicycle of the above-mentioned brands and models that was purchased from authorized dealers in Germany, Austria or Switzerland during the campaign period and registered via the online form on the campaign website. Returning/exchanging the bike excludes participation in the promotion.

When paying out in non-EU countries (in this case Switzerland), slight fluctuations in the refund amount may occur due to the exchange rate. The participant is not entitled to a further refund.

8. Payment account

The reimbursement amount can only be transferred by bank transfer to a payment account that is accessible in the SEPA payment standard and can only be transferred if the bank details are complete and correct. The IBAN is required for the bank transfer.

The participant is responsible for the accuracy of the IBAN provided.

The person entitled to participate will receive the amount transferred to the specified account four to six weeks after the purchase of the bicycle of the above-mentioned brands and valid registration.

A cash payment of the refund is not possible.

9. Interruption / premature termination of the promotion

Winora / Ghost reserves the right to interrupt or terminate the promotion at any time for good cause. Winora / Ghost will make use of this option in particular if proper implementation of the promotion cannot be guaranteed for technical and/or legal reasons. Claims for reimbursement already acquired remain unaffected.

10. Limitations of liability

The participant is responsible for the accuracy of the contact details provided, in particular his/her e-mail-address and IBAN.

Winora / Ghost is not liable for technical failures that lead to the unavailability of the offer, unless there is intent or gross negligence.

Winora / Ghost and the companies involved accept no liability for loss of data, in particular in the course of data transmission, and other technical defects.

Winora / Ghost and the companies participating in the fulfillment are not liable for failed transfer transactions due to incorrect account data.

11. Other regulations

Winora / Ghost reserves the right to exclude participants from the promotion due to false information, manipulation, the use of unauthorized aids or other fraudulent advantage-taking. The excluded participant has no claims against Winora / Ghost. In such cases, the transfer of the refund amount may also be subsequently revoked and reclaimed.

Winora / Ghost reserves the right to change the conditions of participation at any time, in particular to adapt them to changed legal and/or technical circumstances. The current version of the conditions of participation is available at https://www.dealer-cashback.com.

For cashback campaigns with cooperating companies, the conditions of participation drawn up for the cooperation apply, which replace these.

The conditions of participation apply to each participant at the time the proof of purchase is uploaded.

The promotion and these terms and conditions of participation are subject to German law. Legal recourse is excluded. The invalidity of individual provisions of these conditions of participation shall not affect the validity of the remaining provisions.

Who can take part in the promotion?
You are eligible to participate if you are at least 18 years old at the time of participation, have your permanent residence in Germany, Austria or Switzerland and have a valid bank account that complies with the SEPA payment standard.

How does participation in the promotion work?
For a WINORA, HAIBIKE or GHOST brand bike purchased during the promotion period from June 1 to September 30, 2024 and registered in the online form with an event code, you will receive a cashback refund of up to €/CHF 300 to the account you have specified if all conditions of participation are met after confirmation.

During what period can I take part in the promotion?
The promotion runs from June 1 to September 30, 2024. Both the purchase and registration of the purchased bike must take place during this period.

Which bikes are eligible for the cashback?
You can receive a cashback for all bike models of the following brands:

• WINORA
  
• HAIBIKE
  
• GHOST
  

You can find a precise list of the models in the conditions of participation. You can purchase these from all retailers who stock the brands in Germany, Austria or Switzerland.

What information do I need to provide when registering online?
Registration takes place via https://www.dealer-cashback.com and requires you to upload your proof of purchase and provide your personal details (title, first name, last name, address, e-mail-address), your bank account (IBAN), product information (brand, frame number) and retailer information.

My registration has been completed and all documents have been uploaded. What happens afterwards?

1. After purchasing and registering the purchased bike, you will automatically receive a confirmation of receipt by e-mail.
   
2. If your registration is rejected for various reasons that do not comply with the conditions of participation, you will receive an e-mail stating the reason for rejection. However, you will then have the opportunity to participate again. Please check all the conditions of participation in detail before registering and enter your details carefully.
   
3. After successful verification and approval of all details, the cashback refund will be transferred to your valid bank account four to six weeks after successful registration. You will receive automatic status e-mails both after successful verification and shortly before the transfer.
   

Important note: Please also check your SPAM folder regularly.

How often can I take part?
Only one entry per person is permitted. You can only use your proof of purchase once. Likewise, only one person per bank account may participate.

Is it possible for another person to take part?
No, participation is only possible under your own name and only as a private individual. Participation in someone else's name, in particular by competition agencies, as well as participation with the help of automatically generated mass mailings and as a company is not permitted.

What must be recognizable on the proof of purchase?
The following information must be clearly legible on the photo of your proof of purchase: retailer, product name, unit price, total amount and date of purchase. The photo/document of your proof of purchase must not exceed a file size of eight (8) MB and must be in JPG, PNG or PDF file format.

Can I participate with an order confirmation?
No, an order confirmation is not sufficient for your participation. A proof of purchase in the form of an invoice must be uploaded.

What conditions apply to my payment account?
Refunds can be made by bank transfer to a payment account that can be accessed using the SEPA payment standard and can only be made if your bank details are complete and correct. Your IBAN is required for the transfer.

When will I receive my cashback?
After purchasing the bike and confirming your registration, the amount will be transferred to the account you specified four to six weeks after successful registration.

What happens if I have entered an incorrect IBAN?
We ask you to check your details again in advance and then complete the registration. If the respective refund amount cannot be transferred to the account you specified for reasons for which Winora / Ghost is not responsible, Winora / Ghost is not obliged to try again. In this case, please contact teilnahme@dealer-cashback.com.

Where can I find the frame number?
Depending on the bike make and model, the frame number is located in the area of the chain stay, bottom bracket or tube below the saddle.

Who is the organizer of this cashback campaign?
The organizer of the cashback campaign is Winora-Staiger GmbH, Max-Planck-Str. 6, 97526 Sennfeld for the WINORA and HAIBIKE brands; and Ghost-Bikes GmbH, An der Tongrube 3, 95652 Waldsassen for the GHOST brand.
